NAHC and other home care associations submitted a lawsuit to the U.S. Supreme Court in an effort to overturn home care aid’s obligation to overtime. The main issues presented were the validity of the new DoL rules affecting the “companionship services” and “live-in domestic services.” The state expressed sympathy towards the disabled people impacted by the rules which increase care costs, but they do not see a need to increase funding support. Furthermore, the brief argued collectively with the Attorney Generals to explain how the new rule will benefit each states financial liability for such programs, and challenges their decision without any statement.
