Supreme Court Blocks OSHA Mandate, Allows CMS Rule to Take Effect

Last week, the U.S. Supreme Court blocked the OSHA mandate in a vote of 6-3. They went on to rule that the CMS rule will stand by a vote of 5-4. According to the CMS rule all home health workers must be vaccinated. In preparation, home health workers must receive their first dose of the COVID vaccine by January 27th and their second dose by February 26th.

“COVID–19 is a highly contagious, dangerous, and – especially for Medicare and Medicaid patients – deadly disease,” the judges stated. “Vaccination requirements are a common feature of the provision of healthcare in America: Healthcare workers around the country are ordinarily required to be vaccinated for diseases such as hepatitis B, influenza, and measles, mumps and rubella.”
