When it comes to the rebut of last week’s proposed rule, which included an aggregate decrease to payment rates by 4.2% less (or $810 million) compared to 2022, providers to expect an uphill battle. That’s according to Seema Verma, former CMS administrator.
CMS developed the rule using strictly data, so although it is still is only a proposed rule with an opportunity to impact it during the comment period, it won’t be easy according to Verma.
“It has to be data-driven,” she said. “I think if providers were able to show evidence [by saying], ‘Here’s the data, this is why we disagree with your analysis. Here’s our analysis.’ And that’s data driven, they have a stronger chance than just saying, ‘We disagree with this from a policy perspective.’ That’s not going to work.”
The public has 60 days to file formal comments to CMS about the proposed rule. CMS is expected to issue the final 2023 home health rule in late October.
