President Donald Trump signed the The Right to Try Act of 2017, on June 1, 2018. The act passed Congress on May 22nd, allowing certain unapproved drugs to be administered to terminally ill patients who have exhausted all treatment options and who are unable to participate in clinical trials. The drugs used must have passed phase I FDA testing and manufacturers must report any drugs used in “Right to Try” to the FDA. The bill limits the liability of prescribers, drug sponsors and manufacturers that provide or decline to provide an eligible investigational drug to an eligible patient.
