Civil Money Penalties Now Applicable to Home Health Agencies

CMS had suspended civil money penalties (CMP) that could be incurred by a home health agency during a Medicare survey until January 13, 2019.  As this date has recently passed, it is now possible for surveyors to now apply the penalties.

CMS can impose a civil money penalty against a home health agency that is out of compliance with one or more of the Conditions of Participation.  CMS may impose a civil money penalty for the number of days that a HHA is not in substantial compliance with one or more CoPs, or for each instance that a HHA is not in substantial compliance. The civil money penalty maximum amount per day/per instance is currently $20,521.  There are varying amounts of penalty depending upon the type of noncompliance.
