CMS Extends Medicare Enrollment Moratoria for HHAs

CMS has announced a sixth month extension of a statewide moratorium on the enrollment of new Medicare home health agencies in Florida, Illinois, Michigan and Texas, to prevent and combat fraud and abuse. 

“The moratoria will also apply to Medicaid and the Children’s Health Insurance Program (CHIP) in each state. For purposes of these moratoria, providers that were participating as network providers in one or more Medicaid managed care organizations prior to January 1, 2018 will not be considered “newly enrolling” when they are required to enroll with the State Medicaid agency pursuant to a new statutory requirement, and thus will not be subject to the moratoria.”

CMS discussed the extension of the moratoria with the Health and Human Services, Office of Inspector General (HHS-OIG). The HHS-OIG agreed that there still is a great potential for fraud, waste and abuse by HHAs in these areas. CMS has determined that the moratorium to monitor the indicators and to continue with administrative actions to combat the fraud and abuse.
