Medicare Legislation Affecting Home Health and Hospice Moves through Congress

Last week, the House of Representatives approved numerous legislation that will impact the Medicare program regarding home health and hospice.  Here is a short description of the bills.

H.R. 6690, the Fighting Fraud to Protect Care for Seniors Act, would direct CMS to establish a demonstration program to study the use of smart card technology to reduce fraud in Medicare.

H.R. 6662, the Empowering Seniors’ Enrollment Decision Act, would allow certain Medicare Advantage enrollees additional time to select a coverage plan.

H.R. 6561, the Comprehensive Care for Seniors Act, would direct CMS to issue a final rule regarding the Programs of All-Inclusive Care for the Elderly (PACE) program by the end of this year. The PACE program provides home and community-based services to certain Medicare and Medicaid enrollees as an alternative to institutional care.

H.R. 3635, the Local Coverage Determination Clarification Act, would improve transparency and accountability in the Medicare local coverage determination process. Revisions would be made for Medicare Administrative Contractors (MACs) process for issuing and reconsidering LCDs that are new, restrict or substantively revise existing LCDs, or are otherwise specified in regulation.
